FILING AOS!

Hello Vj Member,

We are mailing today our application on permanent residency or adjust status, however the problem is we only have 2 pay stubs, hubby just have a new job january of 2010, he's been getting unemployment check in the last 11months and right now we couldnt find his unemloyment pay stubs to attach on his affidavait of support. need help here. is it ok to have only 2 pay stubs? will that be a problem in our AOS application??..

help guys, i would rerally appreaciate the response...

Hello Lei, I just started my new job in December after months of unemployment.

I didn't send my unemployment pay stubs. I included every pay stub from my new job from start date to the day before we sent in our AOS (I think there were four total), along with a letter (confirming employment, job title, benefits, salary, etc.) and W-2 from my new employer. I also included any email correspondence between myself and my supervisor that supported my claim of employment, and my business card.

This, of course, was all attached to the I-864 form, with tax transcripts and all the rest.

Thank you for the respond, hubby doesnt have a business card yet in his new job or even email that suported claim of employment. aside from 2 pay stubs from start date until the last pay check i also have employment letter that says he's employed in the company. will that be ok?

Oh no, he doesn't have to include a business card! Sorry if I worried you, Lei!

I'm just trying to convey that if he's proving employment after a considerable period of unemployment, then including anything and everything related to his job can only help your case. That's why I included work emails and my business card in addition to my letter of employment.

Since he doesn't yet have work email or business cards, I would suggest having him ask his co-workers to write letters stating that he works at "name of company" and maybe a little bit about how they work with him. When John and I were filing K-1, I had two of my co-worker friends (who had lunch with me and John) write brief one-paragraph statements.

Try whatever you think will help!!

john said ill make a letter that will say he was unemployed before the job he has now and been receiving unemployment check before. will that help too? all i can show is the employment letter and 2 pay stub. we run out of time to make things like that coz we are submitting it today, post office was closed yesterday when we got there so will try again today. thank u lots for giving me ideas on these things.

A letter explaining the unemployment was a really good idea. I sent in an email from Unemployment here in California congratulating me on my new job (I emailed them to let them know that I wouldn't be needing any more benefits).

Sounds like you're on your way! And if you and I get RFEs, we'll just make sure we send USCIS whatever else they need, right Lei?

So I have a question... Do you have to include the transcripts from the previous three years (i know its optional though). It seems like all the threads I've read, people have done such. My USC husband makes well over the poverty line but last year, though still over the PL by far, he ended up owing a few dollars to the government. Will this affect anything? I think it was the filers fault as far as calculations, as he's never owed before... HELP
