I received a letter in the mail requesting for Initial Evidence regarding the I-864.

I really need some help to understand what they are asking.

I submitted the I-864 from our sponsor...the same person that was the affidavit of support for my K-1 Visa.

All seemed fine there.

Now they are saying that the I-864 was submitted, but not from the petitioner/sponsor.

They are requesting a completed form from the petitioner/sponsor listed on Form 1-130 or Form 1-129F. Even if a joint sponsor will be used, the petitioner/sponsor must submit form I-864

Also, the letter said...The joint sponsor on Form I-865, Affidavit of Support must be a U.S. citizen, U.S. national or lawful permanent resident of the U.S. And with that they request evidence of the Joint sponsor's status.

I have no idea what this means....please help!!!

We only have one sponsor, is it possible they filled it out wrong? We don't have joint sponsor, so I don't understand that.

Thank you.

If your sponsor is anyone other than your spouse, your spouse must also fill out the form even if s/he doesn't make enough to support you. It sounds like you are using someone else as your sponsor and gave them the info from that person but not from your spouse, so that is what they are sking for.

Do I have to send in the whole package again, including all the forms from our sponsor again?

Or just the I-864 filled out by my husband?

Just the I-864 for your husband, if there was anything else they wanted they would have put that on your RFE as well, so the rest of your package should be fine. I would include a short letter as well with it maybe just explaining this is the form from your husband to accompany the form they already have from your sponsor.

Husband's I-864 must also have the past tax forms, and if working: letter from employer and recent paystubs.

If not submitted already send proof that your co-sponsor is a USC or LPR. (passport, US Birth Cert, or Green Card)

Here's what you would send in for the I864 when you have a joint sponsor, if they don't live with you. If your sponsor lives with you, things are different (mostly they do I864a instead of I864)

Based on what you posted, I've bolded the things I think you are missing....

I-864 detailing petitioner's (US citizen half of the happy couple) financials

- I-864

- Proof of current income (like employer letter, recent pay stubs, etc)

- Tax transcript (or COMPLETE return) from the last taxable year, which is currently still 2008, as some people can't file for 2009 YET. If you didn't file taxes, you need to show why you didn't need to.

I-864 detailing joint sponsor's details

- I-864

- Proof of US citizenship (Natz. certificate, birth certificate, passport ID page) OR Perm. Residence (Copy of green card, etc)

- Proof of current income (employer letter, recent pay stubs, etc)

- Tax transcript or COMPLETE return from the last taxable year OR proof of assets (whatever you're using to qualify)

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

More detailed time line in profile.
