My fiance and I have just started the process of moving him to the United States from England. We are just completing the I-129F form and associated documents currently. Here are my questions:

1. I keep seeing NOA1 and NOA2. What happens at each of these stages?

2. Once the I-129F paperwork is approved, it is my understanding there is an interview that my fiance would have to attend in England. Once this interview is conducted, how long does it take to receive the visa?

3. Once the visa is granted, how long does my fiance have until he must move to the United States? We are not looking to get married until the middle of next year (may 2011). I understand that we only have 90 days from the day he arrives in the states till we get married. Basically, once the visa is granted, is there a time limit for him to move?

4. How many photographs did you send in your initial package to prove your relationship? I do not want to go overboard.

Thank you so much for your help. I am trying to stay grounded with this whole process and having OCD doesnt help...lol.....

I'm not sure the visa turnaround for London. Look in the UK regional forum for feedback.

The visas are valid for 6 months. They can extended at the discretion of the Consular Officer

Photos don't prove a relationship. With the petition you need to prove that you've met at least once in the last 2 years. Several (5 - 20)photos that show you together over the time you've known each other is sufficient.

You can always have a civil ceremony right after he arrives and then have the pomp and circumstance later. If working is an issue then that may help as he won't get work authorization until after marriage and you've submitted the work authorization forms.

Hi,

Reading the guides above, will REALLY help you through the process. But briefly, NOA1 is a notification from the USCIS that your application was accepted. The NOA2 tells you that your application will be sent to the VSC for processing.

Once the interview is completed, and yes this will be in his country of origin, IF HE PASSES, typically the visa will come in the mail in a week or so. This varies greatly from embassy to embassy and country to country.

Once the visa is received, he has approx 6 months in which to move to the USA.

You will be proving your relationship is real. Some people include a ton of pics. We included about 10, showing us together and me in Holland meeting his family for the first time. You will have to REALLY prove your relationship is valid once you are married and filing for AOS. I think they have a tighter scrutiny of your proof.

1. NOA1 is a notice that the USCIS has received your paperwork. NOA2 is a notice of decision on your petition, and "usually" comes 3-5 months after your initial filing.

2. Correct. He will have to attend an interview at the US Consulate in London. Also, he will need to get a medical exam, police reports, etc. The time after which he gets the visa varies, but it will probably be a week or so, if everything goes well.

3. I think the visa is valid for 6 months from when it is issued. Someone will no doubt correct me if I'm wrong! Then, after arriving in the US, you two have 90 days to get married. People for whom the process has gone faster than they expected have had success in delaying the interview at the consulate stage so that they can meet the requirements for the 90 days as well as have their wedding on the planned date.

4. I sent 4 with my petition, others have sent more or less. I think as long as you don't send dozens, you're alright.

I'm jumping a head of time, but after you are married open a joint bank account to pay for mortgage, car loans, utilities, etc. Both names should be on the mortgage, car insurance, checking account, tax returns, hospitalization, life insurance, and anything else that you can think of to include. For the AOS process you are providing evidence that you are a couple and living together.

For times and stuff, you don't have to worry about filing too soon at the London USE because after you get your NOA2 and the petition is at London, you have up to a year to have your interview if you request it and keep in contact with them. Once you get the visa, you have 6 months to enter and 90 days to get married...

Something else to consider: have him come here when you do get the visa earlier on and have a civil ceremony (at city hall) and have a big wedding in May 2011. Many people with K1 visas do this.
