I lost my job beginning of 2009, and was unable gain any employment in 2009.

I am starting a job in March/April, and hopefully will be able to show new paystubs from my employer.

I am planning to file application for my wife in 2010. Can I use 2008 tax return? or should i use 2009 return that is pretty much unemployment benefits. I'm worried this will be looked upon as a negative even though I am employed at the time of filing.

Has anyone been through this situation? How will my unemployment viewed upon?

Trying to figure out the best way to proceed.

You will need to submit at least the most recent year's return (and supporting documents) - this could very well end up being 2009's (depending on when you submit the affidavit). You may - if you think it will help, submit additional year's so you could also submit 2008 (even 2007) if you like. Which ever way you do it, it will be evaluated on your current earnings.

Financial information is not disclosed at petition filing. Later in the process, you will submit an I-864 affidavit of support. The primary criteria being evaluated will be your current income. At least the most recent tax return is required, so by then it will be 2009. Past unemployment is not a major factor if your current income qualifies and is well documented.
