I-130 questions

Theres a question on the I-130 asking what our last known address was living together? Well, by the standards of my apartments, my wife doesn't live here because shes not on my lease but she has been down with me for months visiting. Should I write an address here or just write N/A because she still has her address in Canada. SHe does stay with me but shes not on my lease because I cannot add her as a non-resident. Shes only down here as a visitor for 6 months at the moment so I just need to know what to write here before I send the packet out in a the next few weeks. Thanks guys

It is always best to be honest. Perhaps attach a supplemental page explaining your situation. If she is just on a visitor visa, you probably don't want to say she is living here with you because that might raise red flags. The term visitor would indicate this is not her home.

Agreed, she is visiting, not living. If her primary residence is in Canada then she is not living with you but 'staying' with you. You do not want to give the impression she is living down her without proper authorization.

So in this spot, do I just write N/A? Would that be okay? And she doesn't have a visitor VISA. As a Canadian, they don't require visitor visas or I-94's to stay in the states for 6 months.

I did ask in an earlier post though that since she is down here with me that the spot that asks for her I-94 number that what we should write in that spot. I was advised to just write N/A but we were told at the border coming through that she didn't need the I-94. Hopefully Im going about this right.

No, we are lucky. We don't require visas to visit and have very lax regulations when it comes to staying.

If you have never lived together, then put N/A, same with the I-94
