filing US taxes while waiting for 10 year ban

What identification is required by the US for the foreign spouse when filing taxes if the spouse is denied a visa and subject to the 10 year ban. I assume he won't have a social security number or tax ID? This may be my situation if the I-130 and waiver is denied and we have to wait out the 10 year ban. As far as I know in order to file married filing jointly the spouse has to have a social security number or tax ID. I was told my my tax advisor that without either of these I would have to file Married-filing-single and will lose the marriage tax credit I would otherwise be entitled to receive if I could file Married-filing-jointly. What do I use as an identification number for my spouse on my taxes if he is denied the visa waiver and we are waiting out the 10 year ban? Thank-you for your response.

ban has nothing to do with it... if your foreign spouse is not eligible for a SSN then the IRS will issue an ITIN... Look up form W-7
