GC holder marrying an F-1

hey,

I am currently a GC holder(completed three years) and i want to marry my girlfriend who is on F-1. She has been on F-1 for a year. After marriage, do i have to file for adjustment of status for her or can she stays on her F-1 status as long as she is going to school? can i wait until i become a citizen and file for aos?

any suggestions or pointers in this area will be very much appreciated.

i suggest you don't file anything for her, at this point.

you qualify for usc in 2 years - once you have that in hand, file 'the big package' - see http://www.visajourney.com/forums/index.ph...page=i130guide2

She can stay on F-1 status as long as her school is handling her documents AND she remains in school.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Agree with Darnell.

I don't think spouses of LPRs can AOS. So wait till you become a USC before you file the I-130 and I-485 for her. As long as she maintains her F-1 status she will be fine.

12/07/2012: 10 year card production ordered.

09/25/2013: N-400 NOA1

10/16/2013: Biometrics completed

12/03/2013: Interview

12/20/2013: Oath ceremony
