hope i come the right place,hi,my girlfriend came usa on feb 2005 via the visa vaiver program,and she overstay,she lost passport &i94w ,the silly thing is we dont have any copy of them,right now,she got the new passport, i read lot about AOS,she must need a proof of entry,can she replace i94w even she over stay and no copy of previous i94w,or can she do FOIA to ge record of entry?by the way ,she got police report!!any one can help me?thank you!!

You mention she's your girlfriend-are you planning on marrying? She can't AOS as your girlfriend.

It is possible to adjust from VWP with overstay but yes, a consultation with an attorney would be a good idea in your case.
