I knida know the answer to this question but I need to get it off my chest anyway!

My current wife is doing everything in her power to prevent our divorce from going through, it's driving me mad as I can't do anything until the divorce goes through.

I was thinking that if we (my fiancee in the US and I) applied for the K1 now by the time the paperwork went through and I got my visa the divorce would have gone through.

It would mean telling a porkie pie about being already married but I miss my baby so much and being apart is tearing us both apart.

Comments would be appreciated!

You would have to submit a copy of the divorce decree with the application, so you can't really apply in the process of waiting to be divorced.

Unless you left it out and waited for an RFE! But we do not recommend such blatant pork pie behaviour on VJ.

Seriously, the waiting and being apart sucks, but this is serious stuff, so you don't want to do anything half-arsed. Good luck.

needed a divorce too - before starting this journey. You need to submit the divorce decree when you apply for a K1 visa. I needed it for the lawyer right away. It took me 7 months to get the freaking divorce. Then I could go ahead with the visa. Good luck- it's not worth the funny buisness when you are risking your whole future.....

Your words "you are crazy for even thinking about it!" Feel free anyone to correct me if I am wrong, but you need to be divorced in order to begin the K-1 process - in fact, you need to write a letter of intent stating that you are legally able to remarry. Sorry ... I know it's a long, frustrating process, but as many have said here before ... it's allll worth it in the end.

What exactly is your current wife doing to prevent the divorce? If one party of the marriage no longer wants to be married to the other party the one party can go through with the divorce without the other parties consent.

i know the feeling i had to wait over a year for the divorce to all go through, my partner had to kiss his ### to make sure he finally did the uncontested divorce as we had no money for lawyers...

worst year of my life, but it was all finally over 2 weeks ago and we are going to put in for the K-1 this weekend.

just try and stick it out as there would be nothing worse than being denied

My ex is in Canada and I have to wait 2 years unless she doesn't contest. She is insisting (and so are the canadian courts) that I pay for her 2 children from a previous marriage even though she gets money for them from their father (her other ex)

I really don't understand how they can allow her to get paid twice for the same children but thats seems to be the law over there, and I simply can't afford to pay for 3 children.

If I could I would just to get the divorce through quicker......

How can they insist that you pay CS for two children that aren't yours biologically, since she is already receiving CS from her previous husband? Never heard of that.

Hope things work out for you soon...but you will need to submit a certified copy of your divorce decree with your K-1 to show your eligibility of marrying again.

I understand the hell too. We had to wait over a year for Darcy's divorce to go through because his ex is a witch and was causing all kinds of problems. I never thought we would get through it but we did and filed in April.

It will be a difficult journey but you will make it! Good Luck!
