Question about W-2 and 1099 Form for I-864

Hi guys,

Should I need to send a copy of W-2 and 1099 together? I only have form-1099, can I just send this form? (The place where I work didn't have W-2 Form, form-1099 is the only form that they gave to me at the end of the year) Or I have to request a copy of transcript from IRS? I work in beauty salon and the owner just gave me form-1099 at the end of the year only and every year I had to go to the tax preparer to file the income tax . Is this case considered as "self employed"?

Yes, you were an independent contractor (just another name for self-employed person)... so the 1099 will be all you have ... so go with what you got

FWIW, the amount on the 1099 should probably show up on your Schedule C attachment to the 1040. So yo will want to submit your entire tax return and your 1099

If you "only" work in that one beauty salon, then what your employer does is borderline illegal, a means to avoid paying employees' benefits. Independent contractors usually have more than one job.

Anyway, you need neither a W2 (which is what employees get) nor the 1099. You need the tax returns or tax transcripts. After you filed your income taxes, you'll get those forms.

@ Payxibka and Just Bob: Thanks for quick reply . And one more question: Should I need a co-sponsor?

in 2007: I was a student, so I didn't file income tax due to no income. ( Of course I will submit a letter to NVC to explain why I didn't file the income tax for this year)

in 2008: Got a job in May 2008 (income was not enough for 125% poverty, because only worked for 6 months)

in 2009: Exceed 125% poverty

What should I do? A friend of mine told me that just send all the income tax return that I have, including bank statement (saving and checking account). If they send you a letter requiring a co-sponsor, then you will find a co-sponsor, if they don't then you don't need to.
