civil surgeon and TB test results

HI Everyone,

This is frustrating. Naty had the follow up TB test done here in Ft Lauderdale by a Civil Surgeon. They handed me the results from the chest x-ray which were negative. The civil surgeon will not certify the results of course because he wants to do the entire medical exam again. - And I know already they are not regulated or managed by the gov, they can do what they want.

- Can I send the results to another CS to have it transcribed onto the I-693? I know they do it for the vaccinations so was wondering if anyone has heard of them also doing it for the TB.

It is written in the CS instructions that they can transcribe results from another doctor - but it also gives them lee way to use their own standards to signing off things.

(CS are regulated by CDC - however, CS's are free to determine if they choose to transcribe or require an exam)

With TB, it's a different case, since the CS has certain requirements they must follow to sign off on TB cases. (whereas the doctor you used may not of followed the same requirements)

was her K1 medical exam already over a year old?

maybe that's the reason why the CS wants to do another medical exam?

if it a year old then she does need one:

Q: Do I need to complete another full medical to adjust status?

Per Section 1245.5 in the Code of Federal Regulations, a medical examination shall not be required of an applicant for adjustment of status who entered the United States as a non-immigrant spouse, fiancée, or fiancée of a United States citizen or the child of such an alien as defined in section 101(a)(15)(K) of the Act and §214.2(k) of 8 CFR chapter I if the applicant was medically examined prior to, and as a condition of, the issuance of the non-immigrant visa; provided that the medical examination occurred not more than 1 year prior to the date of application for adjustment of status.

if it's not a year old you can definitely go to a different CS for the transcription of the results

Her St Lukes was in July of last year, so it is just about 6 months old.
