Hello

I have recently started looking into the K-1 visa process, My boyfriend lives in the UK and I in the USA and we wish to be married in the USA. My concern comes down to the income part. Last year I know I did not make enough to be above the poverty line. This year I should be fine but not 100% sure. This is a big concern I would hate to get that far in the process then be denied because of income, and Im not sure I would be able to get a co-sponsor to help out.

I was wondering if this was an issue anyone else had to face or any advice to help. If we are denied based on income are there any other alternatives besides a co-sponsor?

Unfortunately, I think a co-sponsor is your only alternative to making the full income yourself. Or anyway, I can't think of anything else. But you know, a co-sponsor doesn't need to be a family member; it can be ANYONE that is willing to do the paperwork with you. Are you sure you won't be able to find anyone? Ask around, explain your situation, and I'm sure someone in your life will be willing to help out.

mmmm, I was thinking of only asking Family members, but here would be my next question and im sure the question of anyone who wasnt family would ask me if I asked them. What responsibilities exactly would them being a co-sponsor would they have? Or if you can point me to a link which may answer this. My googling skills are horrible.

The I-134, unlike the I-864 is not legally binding, and it is the I-134 you will be required to submit for a K visa. The I-134 when requested is one of many things used to determine if an applicant will or wont become a public charge. You will however need someone to sponsor if you do not meet the poverty guidelines. There is the option of self sponsoring if your fiance is in that position. Keep in mind that the I-864 which is legally binding has different requirements and you will also need to show 125% of the poverty guidelines. You may need to consider that in ensuring you will be able to meet this once you get married and apply to adjust status.

I see 2 concerns here. One is immigration requirements. The other is staying alive - paying for food, clothing, and housing. Whoever will be helping you pay your bills should have little objection to signing a non-binding offer to pay.

As aussiewench points out, things will become a bit tougher on the immigration front at adjustment time, when the offer to pay will become binding.
