After looking up info on replacing a NOA ($340, 3 month process time), I'm dreading going home to explain this to my new wife. She shipped all her stuff here right when I moved us into a new home. In the aftermath of moving, we can't find the NOA2 from her K-1.

Question:

I see that USCIC won't process an AOS packet without the NOA2. However, would they still process the EAD application? Can they reject the AOS but still proceed with the EAD or does the EAD require the NOA2 as well? Besides the fact that my income just gets us by, my DW is a type-A so the idea of not working for 3 months was hard enough, but 3 months (NOA2 copy) and then ANOTHER 3 months for EAD approval may be more than she can take. She's only been here 3 weeks and is already bored to tears during the day (tears is literal).

Useless Rant (while shaking first at the sky):

We have to send USCIS their own document just to prove that...they issued us their own document? And they won't approve the AOS until we prove to them that they gave us something that's right in their own database? That's asinine! $340 for some USCIS gov't plebe just to get off their butt and make a copy of something???!!! I hate gov't bureaucracy!

The different forms are all seperate, and they would go their seperate ways once they start to go through the package, that really depends on how they break it down.

Did you happen to copy it for your finacee's interview? (some people do that)

You could use that.

You would most likely get an RFE for the missing NOA2, not a rejection.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I'm still trying to track my copies down; it's a double whammy on missing copies right now. I believe what I sent her for her interview was a color copy, but I'm not sure. I'm tearing through all our stuff tonight to try and find it.

Oddly, we're more concerned about the EAD going through than the AOS at this point.

"...depends on how they break it down" Yeah, that's what I'm sweating over! Seems we'd be at the whim of the reviewer, whether or not they felt like sending the EAD off for approval while RFE'ing the AOS itself, or just holding up both AOS and EAD just because they're in the same package together.

I'm praying we have luck finding the NOA2. Someone mentioned using the email notification that NOA2 was issued; pretty sure I have it, but not sure it that would help anything.

I hope you get to find your NOA2 soon.

Just keep in mind next time to either photocopy important documents issued by the Immigration or scan the original document to have a soft copy that you can print when needed.
