Hi all!!!Before i post my question, I'd like to take this opportunity to thank all the people who have helped me out regarding my queries and for those who prayed for me. As for my question, if I apply for my AOS and my fiance's income won't be able to meet the required income (I am assuming the poverty guidelines will be increasing come Feb.), can he add his mom's income so he can be able to meet the requirement? He lives with his mom and her half sister (and I too will be living with them soon), he doesn't have any dependent but in his I-134, his household size is only for 2 since he doesn't have any dependent. Will there be any discrepancy if he will use his mom's income for the I-864?

Ok, from what I gather...you will be the petitioner and your fiance is the sponsor? If that is correct then im using his mothers income is fine. Using the income of someone within the household along with the sponsor will not be an issue. Just read the instructions for the I-864, its all there. And I think you will need I-864A for his mom along with the original I-864 for him.

JAN 27th 2010 Medical completed Jan 27th

FEB 17th 2010 AOS + I-130 package sent

FEB 25th Got emails with all receipt # ( but not able to check on USCIS site)

FEB 28th Online status check available

MAR 1st Received Hard Copy of NOA's in the mail

MAR 8th Received Biometrics appointment in mail: for Mar 18th (however no updates on site or email notifications)

MAR 9th Biometrics complete via walk-in (All docs touched on USCIS site)

MAR 26th Received interview appointment (For May 6th)

APR 23rd Touched on I-130 and I-485

APR 26th Touched on all docs, EAD card production ordered

MAY 1st Advance patrol in mail

MAY 6th Interview (Request for additional information)

MAY 6th EAD in mail

June 1st (RFE mailed in)

June 28th Notice of approval on USCIS website

July 3th GREEN CARD INT HE MAIL!!!

Ok, from what I gather...you will be the petitioner and your fiance is the sponsor? If that is correct then im using his mothers income is fine. Using the income of someone within the household along with the sponsor will not be an issue. Just read the instructions for the I-864, its all there. And I think you will need I-864A for his mom along with the original I-864 for him.

Hehe. Sorry, i wasn't able to clarify that. I'm the beneficiary and my fiance who is the USC is the petitioner. My visa is already approved and i just want to be ready when I adjust status after we get married in the US. Thank for your quick reply luckygoat. :thumbs:

o ok, yea...you should be fine once his mom income meets the requirements. And dont forget she has to fill out a seperate firm along with your husband.

Hmmm. can't she just fill out the I-864A if she's going to be a household member? I think I read somewhere where a household member can combine his/her income to the sponsor's income. I hope i'm right with this. Because if we get her as a joint sponsor, she might not meet the required income as well. Sigh.

Yes thats what I meant. Combine the household incomes, instead of using her as a joint sponsor since they live in the same house. She would still need to fill out a separate firm (I-864A) as i mentioned along with your husband I-864. Just follow the instructions on the firm.

They can combine incomes if she (his mom) fills out the I-864a. She will have to attach all her evidence of income also and attach proff of US citizenship or permanent residency.

I do not understand though, if he qualifies for the I-134, why would he not qualify for the I-864? Guidelines increase March 1, not February 1. They take affect for USCIS on March 1 and for the consulates on April 1.

Here's the thing. when I had my interview, his income was jsut a little ove the required income for 2. I found it odd though that the CO did not even ask for my fiance's employment letter, bank statement and pay stubs. So since the poverty guidelines will for sure go up, then he might not meet the required income anymore.
