It is very obvious for anyone who has been involved with immigration that she was sending red flags all over the place.

asked questions about her rent and if she was pregnant.

Sounds to me like she was intending to immigrate to the US not just visit and sounds like that is what Immigration also determined.

But she plays the oh I am Muslim, I was discriminated against, blah blah blah

Sorry I have nothing against Muslims just against people who use their race/religion/sexual orientation/etc. as an excuse to yell "foul" when there are/were legitimate reasons for what happened.

Kudos for the Border Patrol folks doing their job in a professional manner and not allowing entry to the USA of a person who obviously had no intention of returning to Canada. The simple fact is that this is not racial profiling as the woman claimed, but border enforcement. If her husband lives in Cleveland, Ohio why hasn't this woman filed petition for a K-3 visa. Why did she only have a one way ticket and not a round trip.

Good job Border guys. The moral of the story is that if we all have to follow the rules for LAWFUL admission into the USA then so does that woman. Being Muslim has nothing to do with it.

I notice that the CBC story did not specify whether Tariq Abouhash is a US citizen (we cannot assume it based on the info given); the K-3 can only be used if he is.

If he is a Canadian on temporary work visa (such as TN-1, H1-B, L1-B/A), she could have asked CBP for a dependent visa (she would need to have proof of his temp status and her Canuck citizenship for this); if he is there on a GC, then she is SOL.

(it may be surprise that if he is on H1-b, she can get H-4 without ever darkening door of consulate/embassy)

Would CBP accept a nikah as proof of marriage? Or would they require a secular marriage certificate? My brother just married a Muslim woman, and they didn't get a secular marriage certificate until months after they got the nikah. This couple might very well not have a secular marriage certificate.

I'll give you a fourth-hand belated attempt at answer (I'm going with the assumption that Tariq is a Canadian citizen working on TN-1).

The 1998 words by Limey-Canuck Stuart (or was it Stewart?) Brooks on a Canada-to-US-business-immigration forum: "when you get your visas (primary or dependent) at POE/PFI, CBP officers there can (and you can bet they will) ask questions (to you and family memebers) to see if they can trip you up and deny you (whether first-time or renewal). Their assumption is that everyone they see who is not a US citizen or GC-holder is attempting to immigrate to the US and that they have a mission to prevent it."

So, it is likely that a nikah along with a xerox of her husband's TN-1 would have sufficed. Based on the news-item, I think that she was missing one or both documents and assuming that CBP would accept oral declaration--or (more dangerously) was under the common (unfortunately not restricted to naturalised Canadians, some born-and-raised in Canada also do this--as I saw on the abovementioned forum) erroneous assumption that Canadian passport allows free access to the US.
