My partner (who is the petitoner) was born on a US military base in Zeist Holland. His father is a US citizen born in America (who was in the US air force at the time based in Holland) and his mother is Dutch.

On the I-129f application question 3 would we tick that his citizenship was acquired through birth in the US?

My husband was similar but UK citizen on UK military base. The base was considered UK territory, and I believe US bases are also considered US territory.

Agreed. US military bases abroad are not considered US territory. Being born on a US military base abroad is no different from being born outside the base, as far as citizenship is concerned. The only minor difference is that the base personnel will usually handle filing the registration of the birth with the local US Embassy.

Are you trying to fill out the form without reading the instructions?

I would expect that there will be a need to prove Citizenship of your Fiancé and an RFE for such proof would be forthcoming, if not included in your application. However, I have no basis for that opinion.

In any case, you might want to think about acquiring his certificate of citizenship at this time.

Read this: http://www.uscis.gov/portal/site/ to apply.

Otherwise...

3. What Documents Do You Need to Show That You Are a United States Citizen?

C. If you were born outside the United States, and you are a U.S. citizen through your parents, give the CIS:

1) Your original Certificate of Citizenship, or

2) Your Form FS-240 (Report of Birth Abroad of a United States Citizen).

D. In place of any of the above, you may give the CIS a copy of your valid, unexpired U.S. passport that was issued for at least five years. You must submit copies of all pages in the passport.

OR:

4. If the documents needed above are not available, you can give CIS the following instead. However, the CIS may request in writing that you obtain a statement from the appropriate civil authority certifying that the needed document is not available. Any evidence submitted must contain enough information, such as a birth date, to establish the event you are trying to prove.

A. Baptismal certificate. A copy, front and back, of the certificate under the seal of the church, synagogue or other religious entity showing where the baptism, dedication or comparable rite occurred, as well as the date and place of the child's birth, date of baptism and names of the child's parents. The baptism must have occurred within two months after the birth of the child.

B. School record. A letter from the school authority preferably from the first school attended), showing the date of admission to the school, child's date or age at that time, place of birth, and the names of the parents.

C. Census record. State or Federal census record showing the name(s), date(s) and place(s) of birth or age(s) of the person(s) listed.

D. Affidavits. Written statements sworn to, or affirmed by, two persons who were living at the time and who have personal knowledge of the event. For example, a birth, marriage or death. These persons may be relatives and do not have to be citizens of the United States. Each affidavit should contain the person's full name and address, date and place of birth, and relationship to you and must fully describe the event and explain how he or she acquired knowledge of the event.

Hello,

I have a similar scenario. I am trying to answer Question#10 from I-129F form. I am a US citizen but was born outside US. I acquired my citizenship through my father. I read the instructions and according to that, I have to provide an original Certificate of Citizenship or my Form FS-240. I only have Form FS-545. Is that similar to the FS-240? Will that be sufficient or do I have to provide them copy of my US passport as well? Also, if FS-545 is okay, do I really have to submit the original as instructed or a copy(certified copy) will be enough?

As the instructions say you have to submit Form FS-240 or an unexpired U.S. passport. You do not submit originals unless the document says to and the only originals that are really needed are the Immigration forms for the visa. Your personal documentation can be copies.

Just to confirm I have read the instructions and we are sending a copy of his unexpired U.S. Passport. I was just trying to see if anyone else had experience of this and whether the U.S. Passport will be enough or whether there would be an RFE for his Certificate of Citizenship.

Hi, I have the same question! Please let me know what happened with your husband. I was just sent an RFE for proof of citizenship - I sent in a copy of my passport but it seems it wasn't enough. Was I supposed to send in a Report of Birth Abroad (don't have one). You were in my exact situation - please help! Thanks.

You're replying to a post that's more than two years old.

Did you submit a copy of every page of your passport? Was your passport issued with a validity of at least five years?

We were never sent a RFE. I agree with the above questions JimVaPhuong just asked - Did you submit a copy of every page of your passport? Was your passport issued with a validity of at least five years?
