F3 Category & Petitioner stay in U.S.A.

Hi All,

I have question. My uncle is U.S.A Citizen & he had filed for his married son in F3 category. My uncle now went back to india due to health issues & won't prefer to come back untill his son case is current or close to that.

My question is when there case is current do my uncle have to be is U.S.A or how long Petitioner is allowed to stay overseas for F3 category.

AFAIK, since the petitioner is a USC there is no requirement for him to be present in the USA as long as he maintains US domicile, and has the ability to sponsor when the time comes

But he needs to be there in US when the time of visa is nearest as the communication will be directed to his address and if he is not there,,, he might be unaware of the ongoing process.
