I'd like for my brother-in-law to come visit in the US. Normally he'd be allowed to come over on the VWP but He's been arrested for possesion of marijana, so I know this will be on his record. I'm not sure the difference between an arrest and a conviction but if it does make a difference this was an arrest causing him to be held a few hours.

I'm just wondering what he'd have to do to get a B-2 visa and if he'd be required a wavier? I know nothing about the B-2 process nor the waviers so any information and/or experience would be helpful.

July 23rd - 30th, 2008 -- Damian's Mum Comes to the US for our wedding.

July 25th, 2008 -- Wedding Day!

March 16th, 2009 -- AOS Sent

May 8th, 2009 -- EAD & AP Approved (51days)

July 14th, 2009 -- AOS Approved!! (118days)

July 21st, 2009 -- Green Card Received (125days)

No RFEs the whole process :) All done myself.

December 4th - 30th, 2009 -- Visited England

April 8th - 30th, 2010 -- Damian's Brother visits us here in PA.

January 19th, 2010 -- Damian got his PA license.

December 10th - 19th, 2010 -- Visited England

September 16th - 30th, 2011 -- Damian's Parents came to visit us here in PA.

June 1st, 2011 -- Mailed ROC to Vermont.

February 21st, 2012 -- 10 Year Green Card Received

April 14th, 2012 -- N-400 Sent to Dallas Lockbox

November 26th, 2012 – Damian Became a US Citizen!!!

How long ago was the arrest

I know two people from Ireland who got tourist visas after marihuana cautions (ie got arrested, but not convicted in a court, took a caution), but in both cases the caution was 5+ years before they applied for the visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
