One year if you are healthy or have a Class A condition.

6 months if you have a Class B condition.

Having a Class C condition renders the whole question rather moot.

I am in a similar situation (refiling for a K-1). My Question is:

When does that one year validity end? It could be any of the following things:

1. Is it from the time the time the medical report is done to the time you refile for the next K-1 in US?

2. Or is it when the second I-129F petition is approved by the USCIS?

3. Or is it when the beneficiary receives 2nd packet 3 ?

4. Or is it when the beneficiary has their 2nd interview?

I think I may not have asked the question clearly. Let me try again...........

I understand that the 1 year validity starts from the date the medical report is created and ends once 1 year has elapsed. So, e.g. the medical was done on Jan. 1st 2009 and then my 1st K-1 was denied. So I refile for a K-1 the second time around, now which of the following has to happen before Jan. 1st 2010 (the expiry date) that my medical will be considered still valid:

1. Is it on the date I refile for the 2nd K-1 in US?

2. Or is it when the second I-129F petition is approved by the USCIS?

3. Or is it when the beneficiary receives 2nd packet 3 ?

4. Or is it when the beneficiary has their 2nd interview?

Nothing you babbled about makes any difference. None of those four items affects the validity of the medical exam. 1 and 2 are completely irrelevent in any way to a medical exam. So is number 3. What on earth would that have to do with anything? Number 4 is the only item listed for which you would need a medical exam. If your current mecial exam expires before that date, you need a new one. The medical is good for one year. Period. First K-1, second K-1, whatever. when you present the medical exam for any purpose, it is valid for one year from when the exam was performed. If your second interview or AOS or ANY purpose for which you need a medical exam is more than one year from the date of the exam...you need a new one.

And do not forget the AOS which the mecial must also be valid which occurs after she arrives and you are married. Unless ALL of that occurs within one year of the medical exam...you need a new one.
