Affidavit of Support fee?

Ok, so our son will be celebrating his first birthday soon. And finally we are ready to adjust status! I am nearly finished with the paperwork for this stage. I noticed today on USCIS.gov that there is no fee for the I-864. HOWEVER, the Department of State requires a fee of 70.00 when reviewed domestically. Does this mean anyone applying within the U.S. must pay this fee? A bit confusing. thanks for the assistance.

You do not need to pay a fee - (looking at your info)

However, your a year+ out from your I-94 expiring and your just now filing AOS?

Actually, there is a set window of time to adjust. Your status is dependent on the I-94.

When it expires, you are "out of status", regardless if you married in the 90 days of entry.

Only the NOA for the AOS puts you in "applicant to adjust status" which freezes your status (of not being out of status). Problems with ICE can occur in this "out of status" state. (it appears you haven't had any)

Also, since you are outside the one year mark for the K-1 entry, you will need to re-do your medical exam, again. (the whole thing, not just the vaccinations - as per the 485 instructions).

Jason, don't let anyone scare you about your delay with filing AOS. Of course you know there will be no problems with the delay. The only extra fee I know about is the biometrics fee of, I think, $70. And you will need to do a new medical.

Not trying to "scare" anyone, I just stated the facts, as I understand them. Do with the information as you will.

We're not scared. Nor worried for any reason. We delayed this step of the process because we had a child and my wife couldn't work. It took a full year to work out my finances and make great changes to our lives to accommodate a new mouth in the family . My income has recently doubled. We can now afford to do everything we wanted more than a year ago. Now, our son is celebrating his first birthday and Sasha is ready to return to work. And we're more than ready to finally return to Russia. Its time the family met their newest member. So, here we are. Filing at last. Sasha recently had a renewed complete physical with our local civil surgeon. Everything is in order. And since we're filing before the end of the year, we're using tax returns from 2008. They're the most recent. We cleared the 125% poverty level with no problem. But still will include a few years of W-2s. We've come across a few areas of confusion in some of these applications, but I think we'll address these in another thread. Thanks for the insight guys!
