My wife entered on a K1 visa, we were married within the 90 days, then we filed for AOS shortly after we received our marriage certificate.

A couple of weeks ago my wife's purse was stolen with her passport and I-94 in it. We submitted a police report and purchased a replacement passport from the Brazilian consulate.

My question is, do I need to get her a new I-94? I believe the old one is expired anyway, same goes for her visa, since it was only good for the original 90 days.

She has her biometrics appointment later this week, and it says all she needs is valid identification. Will she need the I-94 for our AOS interview?

Sorry hearing about the stolen purse ;(

Don't recall they I-94 being required for the AOS interview.

The I-94 will not be needed any longer after AOS -

Hopefully she applied for AP if she needs to travel before she gets her GC.

I haven't seen any posts about being asked about the I-94 at the AOS interview (however, they could ask for any original document submitted) - but I would not worry about that to much.

If it is asked for - you could show the police report and new passport if needed.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

As long as you sent in a copy of the front and back of the I-94 with the I485 application you should be fine. I wouldn't worry about getting a replacement unless the interviewing officer asks to see it. Hopefully, you kept a copy.

Forgot about copying it. Yes, good point.

However, I have never heard of them asking to see it. The police report and new passport should be sufficient if they do.
