so i just got my noa2 and it was approved. now i'm starting to get together the i-134 form. i'm a student so my income is very little. my dad will be co-sponsoring for me. i have a question about filling out the i-134 form. on question 9 it states "I have previously submitted affidavit(s) of support for the following person(s). If none, state "None"."

my dad did submit a i-134 for my brother's ex-fiancee. Their approved i-129F was sent back by the Guangzhou Consulate to USCIS and eventually was not approved by USCIS. Unfortunately, their relationship ended because of all the arguing over everything. And they did not appeal. For question 9, should my dad put that he did submit an affidavit of support or should he say "none"?

I would state it, unless the form was'nt kept or copied by the place they used it at.

For example, i filled out one when my fiancee interviewed for a tourist visa, but she was denied, and it was returned to her, so later it makes sense for me to put 'none'.

One extra tid bit, if it was sent back after an interview, then they probably have it on file, and so he should state he has previously filled one out.

It wont hurt his 134's credibility for saying so.

The reason they ask this question is because, at one time, the I-134 was THE affidavit of support for all visa applicants that required an affidavit. Having previously sponsored another immigrant meant you could potentially be on the hook to support that immigrant, and they could count that previous affidavit as a potential dependent for the purpose of counting your household size.

The form doesn't give you any chance to explain whether the previously sponsored applicant ever actually immigrated, or what their current status is, nor whether a binding I-864 was ever filed for them. A consular officer might have a tough time figuring out whether the sponsor might potentially already be financially responsible for another immigrant. Since the consulates have broad discretion with the I-134, they could presume that anyone listed in section 9 is a dependent of the sponsor's for the purpose of counting their household size.
