Yeh, yeh I searched..lol I can't find this answer though. On the I-864EZ form on the second page - household size. I know I'll have to show the number of dependents on my most recent tax return (as per the instructions) but that person is no longer a dependent and hasn't been for this year. I won't be claiming her (daughter) this 2009 tax year. I'm sure my income is sufficient for a household size of 3 but my household will only be Merlaine and I. Do I need to attach an explaination, change it, something, etc?? Or just don't worry about it?

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return

Stupid thing!! It won't let me edit it..lol Another question...

On the 3rd page - Federal income tax info - There are two boxes to check. Top one "I have attached the required photocopy or transcript of my return for only the most recent tax year", then the spot for the 3 tax years and total income. Below that is the "optional - I have attached photocopies or transcripts of my Federal tax returns for my second and third most recent tax years." Dumb question maybe but, do I check both of those boxes?? I'm sending 3 years of returns.

Yeh I know the instructions state I have to include her because I claimed her on my most recent return, I just wondered if they needed to know or cared that she really isn't included in calculating income requirements.

No, just stick with the facts as they ask for them.

You would only mark the second 'optional' box as the first box states that you are only attaching one year

Ok, that was the way I read it too. It's just a little confusing the way it's laid out.
