Hi to all!

I've found this site extreeeemely helpful, I hope I can have a post or two regarding this particular case.

I am married (nearly 3 years) with a US citizen, and filed my first 1485 on 2007, my I-130 was approved.. the problem started when in my interview the official said that my fingerprints didn't go through and I had to.. listen to this request "get a copy of a clean police record of all the states you have lived in"..... at that point I had lived in 4 states (from California to Vermont). From all of those cities only 2 gave me the "record". The remaining 2 didn't helped me out. I had a 15 day limit so I sent a letter with the info I gathered and a ltter stating the difficulty and no response from the other 2. To make it short I received a letter some weeks after that I have been denied the I 485, and that I should leave the country ASAP.

I was out of the country (with an advanced parole) at the time so when I tried to enter the country they sent me to "deferred inspection" where an official sent me to "removal proceedings" court. I contact a lawyer and he suggested to re file everything ( I had the I 130 already approved), so we did... finally I got everything in order (fingerprints, interview, etc) and the email saying "card production has been ordered".

To make things worst My Employment authorization expired shortly after and my employer put me in a leave of absence, months later i was dismissed...

The issue is that I don't have either my (notice of action with that statement) or my green card per se at the moment. My "removal proceeding hearing" is in few days.. What are my chances of having the case terminated?? even though I will probably wont have the card per se of the notice of action?? but with an approved I 130 and an approved I485 at least on the "system"???

So far I have a new job in a multinational firm (with a new Employment card), currently attending grad school, and a solid marriage.

Is there a chance of me being deported?? (worst case scenario).... or what are the chances of the judge extending "his decision" and putting my case in the limbo??

How hard will be to put the "stamp" on the passport at this point so I can travel internationally??

11/13/09 Went to my local ss office to request a ss. Should be getting my card in less than 2 weeks :)

11/21/09 Received my ss card on the mail!

12/07/09 Got a job :)

12/14/09 AOS Approved...Conditional Permanent Resident!

Spare no expense: Retain the HIGHEST-class legal help that you can, si man. And, do not (do not! do not!) attend any deportation hearing without an aggressive attorney glued to your side.

Also, before your hearing, fight for an emergency Infopass appointment -- also with your attorney there.

Prayers, si man. Do your best to let us know what happens.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
