Hi all.

I am ready to submit the I-129F and get this fiance visa process underway.

However my fiance is thinking of visiting me mid-January for a month or two.

Will submitting the application for the fiance visa affect his entry into the US as a tourist under the Visa Waiver Program?

He is a UK citizen and normally has not problem entering the US as a tourist.

But I wasn't sure if submitting the fiance visa might flag immigration and deny him entry into the US as a tourist.

Would it be better to wait until he arrives in the US as a tourist and then submit the fiancee visa, and then have him return to the UK after his two month visit.

Please help and thanks in advance for all the insight.

Just as long as he doesn't lie to the border inspectors, he will most likely have no problems. If asked if he has (or will) apply for the K-1 Visa, he should tell them yes and that he is just now coming to the U.S. for a visit with his fiance, while awaiting approval of the I-129F petition.

Proof of ties to his home country is always a good thing to bring along, such as mortgage/lease papers, most recent pay stub, letter from employer or school that he will be returning to work/school on a certain day, etc.

Good luck with the K-1 and hope you have a nice 2 month visit!!!

Great, thanks for the quick replies and the useful links to further my understanding of our options.

My fiance is currently out of work and I did worried about suspicion at the border since he is coming for a sizeable amount of time. He might not be able to provide evidence of strong ties to home due to being unemployed, etc.

My solution to this was for him come over first in January and then submit the application. I figured whats a few weeks difference if it means he can securely come for a nice long visit. Am I allowed to submit the fiance visa while he's in the US and is it alright for him to stay up to the maximum amount of time the tourist visa permits? Plus would it be easier/less suspicious for him to enter the US as just a tourist?

Thanks again for everyone's support with these queries!

That sounds safer to submit the application after he entered the U.S to visit. I had no problem to visit the U.S while my K-1 was being processed,

but it was costly to have all ducuments translated into English, and I was nervous on the plane. Hope everything goes smooth to you. K-1 to AOS is a long process but if you will get it. Good luck
