Diplomat of Indian Embassy bringing spouse in US

Please help us with this case.... my sister's husband is a diplomat of Indian Embassy and my sister's tourist visa is expired... The employer of my brother-in-law is willing to support my sister, but we DON'T KNOW HOW TO START THE PROCESS...

Maybe because she's already here in the US, she needs to go back to Philippines to process according to them...

Then you have your answer. Do what the embassy tells her.

Family based immigration is not her answer as there is no basis for her husband to petition a visa for her. She needs a diplomatic visa to live in the US.

Agreed. no embassy would have anyone in a diplomatic core who was not a citizen of their country. they're civil servants when back home.

He cannot petition the USCIS for his wife to have any kind of residence because he isn't resident there. He is there as a guest of the US government.

I have a cousin who worked for a few years as a non-diplomatic employee at the Australian Embassy in Washington DC in 1985. She had a work visa. So it is possible.
