So I sent my I-485 out on the 12th of November.

They received it last week (the 17th I believe)

My I-94 expired last Saturday the 21st.

I got married on the 22nd of September, but my wife got in a horrible car accident right after the honeymoon.

So it took me a while to get the whole set together.

Now what ? Do I wait ? Can I call them ?

The check hasnt been cashed yet.

They did receive it in time, but am I now illegal ?

If I need to return to the Netherlands, my wife will have a lot of problems.

I need to take care of her, and drive her places. Pick up her medicine and make sure she takes it.

Get her doctors appointments scheduled and get her there and back.

If I have to leave, not only would it financially destroy us, but I dont she can take any more bad luck.

(its a whole list of consecutive bad things happening, and with her PTSD and depression she cant take any more)

Please help. I dont know what to do and where to turn to, and the wait is driving me crazy.

With the I-129F they cashed the check the day they received it. It's been a week and they still didnt try to get my money. Nor did I get a notice in the mail. We're pretty desperate and pretty much at the end of our emotional rope.

How nerve wracking! No, I don't think you should go home. It's true, you don't have any proof of legal status right now, but you will soon. Keep watching for that check to come in. A week feels like a long time when you're in limbo and under stress like this, but it's not at all unusual, especially with the holiday - they probably have a lot of people on vacation.

Hope that your notice comes soon or they cash the check soon, but I don't think there's anything you can do right now but sit tight. Sorry. :(

sorry to hear your situation. but don't worry. you're not illegally here. the expiration of your i-94 doesn't matter since you already submitted i-485. you're status once you receive the NOA1 will be "pending AOS application" for the short time that you are waiting for the NOA you won't be considered out of status.

in the meantime, you will need to keep documentation of your wife's condition so that when interview time comes, whether or not she'll be healthy enough to go to the interview with you, you will be able to explain to the interviewer, if the need arises.

There is no harm in calling, if your in the system than they will be able to pull you up by name and that should help lengthen your emotional rope. The number to call is 1.800.375.5283. that's the National Customer Service Center.

Getting married satisfied the requirments of the K-1 and essentially voided the terms of the I-94. You are just fine.

If it makes you feel any better my Package was received on the 12th and I didn't get my NOA1's until today.
