Checklist letter response

Hi everybody!

I received a letter from NVC today and don't quite understand what I'm supposed to do.

The letter states that NVC has received my AOS documents.

It also says that my income was insufficient ((my husband 's income is a little bit below poverty guidelines) but I also included my parents' property as additional income which is more than needed), but that consular officer will decide will make a decision during an interview. They suggest I get a joint sponsor but I can't find any joint sponsors at the time. Should I just hope that consular will decide it's ok, since my parents have more property in addition to the one I appraised and included in my AoS package and might even sell some of it?

This letter also stated that they're waiting for Visa Application and Documents (I'm preparing it right now). The letter had a coversheet named Checklist Letter Response with bar code -- do I attach the Visa Application documents to it or do I send some other letter (they didn't specify if I should response in any other way?

If the US citizen petitioner does not have sufficient income and/or assets then they must get a joint/cosponsor who would complete their own affidavit of support. You cannot pledge your parent's assets, only one of your parents can do that by submitting an I-864 orI-864A.

What type of visa are you petitioning for?

I'm petitioning for immigrant visa.

Affidavit of Support instructions state that I can use assets of Intending immigrant , but I can use their income only if they are in US, which they are not.

"The value of your assets, the assets of any household member who has signed a Form I-864A, or the assets of the intending immigrant;"

AoS instructions also say

Assets may supplement income if the consular or immigrationofficer is convinced that the monetary value of the asset couldreasonably be made available to support the sponsoredimmigrant and converted to cash within one year withoutundue harm to the sponsor or his or her family members. Youmay not include an automobile unless you show that you ownat least one working automobile that you have not included.

The letter that I have received today doesn't tell me to get a joint sponsor it just suggests I do it to speed things up. Could it be that a consular has to see for himself if the asset can be used as income (is it possible to sell it and how soon etc.)?

Yes, the CO has discretion as to what is accepted for use as an asset.

There are many types of immigrant visas. Are you applying for an IR1/CR1 visa? K3 visa? Are you applying from the US or directly to the US Embassy/Consulate abroad? Your profile says "other" so that may limit the specificity of comments/advice. If you can update your info that will help.

Who is the US citizen petitioner? Wife or husband?

You mentioned Adjustment of Status before and that threw me off.

The CO does look at the impact that selling the item would have on the owner. If it causes "considerable hardship or financial loss" it could be rejected.

Sorry, I thought AOS meant Affidavit of Support:)

I hope CO will approve use of their assets.

Do you know if I attach checklist letter response with the bar code when I will send my visa documents? Or should I just use Visa documents coversheet? Or both?
