Hi. I got married to a Japanese woman on Oct. 3rd. She entered America on a 5 year F-1 student visa June 15, went to English school June 22nd through August 28th, then as I said before married me Oct. 3rd. We didn't realize that we had to file the I-130 packet 2 months after she got out of school because her F-1 visa expires 2 months after getting out of school. Now it's been almost 3 months since she's been at school. She hasn't been placed in removal proceedings yet. What can I do right now?

File the necessary forms to adjust status and obtain her green card based on your marriage.

Isn't it too late now? It's been almost 3 months since she's been to school and a month and a half since we got married. If I filled it out and turned it in this week, wouldn't they simply reject it because her F-1 visa is not valid now? She's been out of school for 3 months.

Celebrate as USCIS forgives overstays when married to a US citizen. DO as Anh map said.

Don't let her leave the US until she has her GC.
