Hi everyone,

You were all very helpful in getting the K-1 approved (had the interview Sep 28th in Lima, went through without a hitch.

She could get on a plane tomorrow and come here if she wanted.

However, we're waiting for her to come until after Christmas. She wants to spend that last Christmas with them.

She has vacation from her job November 15-30.

Here's our question. Would it be possible to file for a tourist visa to come here Nov 15-30, even though she already has a k-1 visa approved and sitting in her passport?

Anybody with any tips or knowledge would be appreciated.

Yes, she could apply but the visa would be denied. It's virtually impossible to enter the USA with a K1 visa in the passport without activating the visa. Technically, people with immigrant intent don't qualify for tourist visas.

Your K1 visa is a one time entry into the US. You can't come on a different visa to save that one for another time. If she enters and returns to her home country, she won't be allowed back into the US and you will have to start from square one with a new K1 visa. Best for her to wait to come when she is prepared to move here.

08-25-09: Interview date...APPROVED!!!!

12/12/09: Fiancee arrival date WOOOT!

02/20/10: Married and SOOOO happy!

04/20/10: Sent off AOS (finally!)

05/03/10: Rec'd AOS NOA1
