Did anyone attach a copy of the i-130 to the i-485

My husband and I are currently preparing the paperwork for the aos and will be concurrently filing the i-130 with the i-485 and all their form friends.

I was just re-reading the i-485 instructions it asks you to submit proof of eligibility to apply for aos. I am assuming that since the i-130 will be in the same envelope that it will all stay together. But did anyone attach an additional copy of the i -130 to the i-485? Just to be sure?

Thank you in advance for all your help :star:

I'm sure sending a photocopy wouldn't hurt but I don't think it's necessary. We didn't send one with our I-485 since the concurrent I-130 is proof enough

I had the same concern as I was getting the documents ready. But decided that the original I-130 would be evidence enough. Glad to see that the collective thinking is the same!

On the other hand, do I need to include anything else to be "eligible for the classification." Page 5 of the Instructions. I figured an extra copy of the marriage certificate couldn't hurt. :) Anything else that I could add?

We're including an extra copy of the marriage cert too... When it arrives we're waiting for our official cert in the mail, hoping it arrives sooner so we can file early next week. :innocent:

I-485 and I-130 are 2 independent applications. You will get separate answers for each individual application. Therefore, you do NOT need to submit a copy of the I-130 to justify the other application. Submit only what is requested.

What is meant by the instructions is that there are applicants whose I-130's are approved or submitted way before they apply for the I-485. In that case you SHOULD attach a copy of the I-130 NOA1 or NOA2 with yout I-485 for eligibility. Otherwise if filing concurrently, just mentioning the category you are applying through is all USCIS needs since your I-130 concurrent filing is not yet accepted by them Anyway. I had filed for the I-130 two months before I filed for the I-485. I simply attached the NOA copy with the I-485. You are required to submit marriage certificates. No question there. Not only is it initial evidence, its what your entire case is dependent on on basis of eligibility.
