1. when did her visa expire? You do not want her to accumulate overstay, even if married to a USC.

2. Is the child your biological son? I believe there are special procedures in place for him to gain citizenship as the child of a now USC.

OK. The most righteous way to go about it then is have her go back to Canada, file for a CR-1 or a K-3 (the K-3 is really not so hot) and wait in Canada for an interview. You can actually file for the visa while she is here under her 6 months tops; and she would go back North for her interview.

Some people just skip the line and file for adjustment of status in your case. It is not very morally OK, and is seen as a way of circumventing US immigration law.

I wonder if there is a way your child already has US citizenship, or has a claim to it. Not sure on this part.

I wonder y it takes longer with k3 addition, it defeats the whole point of creating k3. I find it hard to blief that the cases will exceed by up to 8 weeks, does that imply that it will exceed 5 months? I hope it is not. K3 has an advantage since its interview is often faster than CR 1 and some people can flipped its interview for Cr1 thus regaining whatever delay that might have been incurred, or faster than it would have been for CR 1. I think d embassy ultimately makes a difference.

If your child is a biological child and you have the birth certificate you can apply for yor child to be come a USC by filling out forms at the post office and mailing them with your naturalization certificate.My kids were born in England and me too and wehn i became naturalised as aUSC this year i applied for them too and now they have dual citizenship,they are both British and American citizens,me too.good luck.

Thank you very much! Were you USC when your kids were born? or they do have GC when you got your GC? what form you filled at the post office and what documents you have included for your kids? my child is 12 years old.

My spouse and my child stay with me and I am a US Citizen, I am going to file AOS(485,130,864.131,765 etc) for my spouse and my child, Does my spouse and my child(under 12 years old) require a separate visa petition?

It is an AOS application and yes, the child needs separate documents. Everything, including I-864. The fee for a child under 14 when filing with the parent is $600 per child.

I-485 child ($600) if filed WITH spouse I-485 otherwise $930 if filed separately

I-130 each ($355)

I-864 no charge

I-765, I-131 no charge if filed with or after I-485

separate fee payments as well so in your situation write 4 checks

so.. the fees for AOS is 1365 for fiance plus 955 for child as a total? i'm asking because we will need to file for me + child as well. i didn't know about the $355 for each I-130, is this something everyone apply for?

not for a K-1... K-1's do NOT need an I-130
