Timeline

Hi!

I am getting married at the end of November and intend to apply for AOS as soon as possible because of a prospetive job offer in the early spring. But because Montreal is pretty unreliable at the moment, my fiance and I are discussing filing an EAD before AOS because we dont even know if we can get married on the date we are scheduling in Maryland.

So my questions are:

1. If I file for an EAD before AOS, can I still file for EAD after AOS?

Ive read from many threads that EAD can be filed before AOS and it takes less than 90 days and know about the cost. But after we get married and apply for AOS, do I still apply for another EAD?

2. Has anyone ever tried applying for EAD before AOS? How long did it take?

Green card received: March 18, 2011

Removal of Conditions:

GC Expiration: March 11, 2012

Documents sent: December 13, 2011

NOA-1 received: December 15, 2011

Check cashed: Red said yes when asked

Biometrics: January 25, 2012

Letter approving 10-year GC: September 7, 2012

Production of 10-year GC: September 15, 2012

YEP you can file the I-765 before you apply for AOS. It will cost you $340. Good for a year. No need file again unless you wait more than a year to file for AOS.

Are you sure about that? If she files for EAD it will expire with her I94 making it useless.

2. Immediately, before filing for AOS. As a K-1 visa holder you are technically eligible to file for an EAD immediately when you arrive. However, this EAD will expire when you K-1 expires (90 days) and because of this and the wait time (>90 days) it is a waste of both time and money to bother applying. You will file as category (a)(6), "Nonimmigrant Fiance(e) of U.S. Citizen". (Where to file: mail, efile, walk-in -- only if local office allows)
