is there such a thing as a restraining order in canada? if so can my fiance get a restraining order on her family after receiving a death threat? she will be in a shelter soon and wanted to do it the day she moved out to keep her family from trying to find her. will the police come to the house with her and let her safety get her things?

also could getting a restraining order on her father keep him from being able to enter the country. he comes and goes quite often and a few weeks ago when he was in he threatened her with death after he saw that she wouldn't do what he said. now he's coming back. her mother and brother have been doing the same type of things to her. screaming at her. threatening to kick her out. throwing food in her face. pushing her, punching holes in her walls, etc. they told her that they aren't afraid of the police either and they will do whatever they want. i'm hoping this will keep her dad from coming back. he is the MOST dangerous one. any help will do guys. thank you

Im not sure if it would keep him from entering the country, but it should still be enforcable once she moves (or you can get a new one down there) which if they were to violate would land them in a heep of trouble, which could include jail time, which has the potential of them not being allowed in. She can most definately file for one, and I would definately recommend it. Sounds like her family is pretty messed up and I'm sorry that both of you are going through this. Make sure she gets out of there and reports this to the police as soon as she can.

Normally restraining orders in Canada are issued during a court proceeding so here it looks like you need a peace bond. I hate to pry but could you furnish a few more details about the situation. I would have your fiance contact the local Justice of the Peace ( the number is in the blue pages) and ask if she needs to schedule an appointment or if it is a walk-in situation. Sometimes the local police will handle this, have your fiance phone them up and ask for a 810 recognizance/peace bond. The police will request information from her, including the incidents, the actors and anything else she can tell them about why she feels threatened. The police will then take her info to the Crown Attorney's Office and a Crown Attorney (usually an Assistant Crown) will handle it from there. If the police refuses her then she should go to the JP. She may also wish to go to the JP directly. Take whatever evidence she has to the JP and usually a hearing will be scheduled. Your finace and the person or persons menacing her will testify in another hearing and the JP will decide if a peace bond is issued and the terms. If the other person or persons fail to show then the hearing will proceed ex parte (without the other party) and almost certainly a peace bond will issue. I hope this helps. A great place to find out more about this is at the local student-run legal clinic which is attached to many law schools, a community legal clinic, a battered women's shelter or aid agency or even at the local courthouse where your fiance can ask the court clerk's office or the crown's attorney's office. Good luck and I hope some poor soul who has gone through this nightmare will post shortly with more info.

One's best bet would probably be to contact the local police for guidance in this type of situation.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

She doesn't need to enter a shelter to get the help she needs. If she needs assistance navigating the system, she should call the local police, or some type of domestic violence hotline. After telling them her story, I'm sure they'll point her in the right direction, or someone will go with her to the police. She needs someone local to help her, whether it be to get her connected to the resources she needs, emotional support, or police intervention. Please encourage her to seek help. There isn't much you can do from the U.S. in this matter. SHE is the one that needs to tell her story to someone. You can't do it for her.

Honestly, if I was receiving these kind of threats from my family, a lawyer isn't who I'd called. I would call the freaking cops. And yes, they can help her get her belonging out of the house. If anything, they will be witness to whatever is going on with her family.

Actually the advice we've given (Carla, Flames, you and me) is the best way to proceed. If the finace feels that she is in imminent danger then she should call the police ASAP. In most places this kind of sitution warrants a 911 call regardless of anything else. There are social services and other agencies that can help out but SHE has to make the effort and step one is to contact the police. :thumbs:

After hearing stories of people calling 911 because McDonald didn't have any nuggets left, or because someone's neighbor has their music too loud, I am not afraid to call 911. And I certainly would call them for death threats. :thumbs:
