On the I-485, they ask about Current USCIS Status.

Since I have overstayed, should I put down "Overstay" or "Out of Status"?

As for Part 2, I'm not sure which on I should check. a or b. My husband is filing an I-130.

Visitor

I don't think so, there is a place where they ask how you came in the U.S. (i.e. worker, visitor, etc.) I put visitor there.

Here I was asking for my current status.

One more question. On question 15, they ask name of current employer, do they mean the USC's employer or mine?

I assume you mean on the form I-130? They are referring to your employer since that column is for the alien relative's information. The left column is for the USC

Im fairly new to VJ but it seems you are in the same boat as me. Im also Canadian out of status or VISITOR who married a USC in July.

My question is: Can you file the I-130 at the same time as the I-485 packet..or do you have to wait for the I-130 petition to be approved before filing the I-485.

Thanks in advance

Hi Spartacus!

You need to file the I-130 and I-485 at the same time. :)
