I am the USC, and I just got a new job. I had to fill out tax forms, and it said something about if your spouse is not a resident, to NOT check "married". We are waiting for the green card....so should I have checked married, or single, or married but with holding at a single rate??? I am so confused.

If you are talking about your W2, you can check married as long as you plan on filing a joint application with your spouse. Your spouse does not need to be a resident.

Yes you should check married. You will want to file your taxes together because you need them for your removal of conditions later.

If you will file married jointly (I imagine yes you will) then consider yourself married. As long as you are married you can file jointly. If your wife does not have an SSN when you file, you can still claim her on your taxes. You must do so with the "old fashioned" paper return as the electronic filing systems need a valid SSn for each person.

This was the form w-4. And you are referrring to the "worksheet" which helps you calculate withholdings. There is no legal authority to this form, it is a suggestion, that is all. It is designed to calculate withholdings to minimize your refund or any amount you owe. You can claim whatever you want (they only tell you that you can have MORE withheld if you want). What you claim has no legal standing and is not an enforceable item. If you claim "too much" on this form, you will owe some money at the end of the year.

Nothing to lose sleep over.
