Hi guys,

I entered the states under K1 visa and I was married last week. I am now in the process of AOS but I have some questions about filling out the forms and hope you all can help.

My passport showing my Chinese first name "Siu Ting" with my last name "Chan" and I also got my American name "Tiffany" which is not offically show on my passport but all my friends and family call me "Tiffany". Since I married to my husband, I would like to use my first name as "Tiffany" and his last name "Smith", but I was wondering should I just fill "Tiffany Smith" as my name on the AOS form and so on? Do I have any other step need to do since I change my first name as well?

Appericate any help.

2009-01-28===> NOA's received in the mail
2009-02-01===> Biometric appt received in the mail
2009-02-06===> Completed biometric appt thru walk-in
2009-02-06===> Applied for expedited AP thru the phone
2009-02-14===> Received AP in the mail
2009-02-11===> Case transferred to CSC
2009-02-23===> EAD received
2009-05-02===> Green card received in the mail, no interview done.

Changing the last name is a not a problem, as you know. Changing the first name to something other than what is a use of your name or your husband's name is another matter. First names are relatively easy to change legally, but it must be legally done with a court ruling if you want it to be "official". I doubt any court would consider it before you are an LPR (green card)

On the other hand, first names are changeable "socially" very easily. As you say, all your friends call you Tiffany. I have a brother whose name is "Kurt" and I doubt there is more than 8 people in the world that know this, anyone else knows him as "Bud" which has nothing at all to do with his real name. My father was known by everyone as "Red". You can basically call yourself anything you want and never have to say otherwise except for legal papers. You can even get the bank to print checks in the name "Tiffany". They really don't care what name you out on the checks as long as the legal name is on the account. John Wayne's "real name" was Marion Micheal Morrison. Mark Twain was actually "Samuel Clemens"

My fiance legally changed her last name first with social security. We then used her new name (my last name) on all AOS paperwork. It eliminated any confusion and additional filings. My suggestion, change your name legally before submitting your AOS packet. Good luck.

K-1 VISA

04.20.2008 - Met as friends online

05.01.2008 - 1st trip to Thailand to meet her (2 week trip)

06.23.2008 - 2nd trip to Thailand (Lived with her for 5 weeks)

09.26.2008 - Mailed petition to NSC in California

10.02.2008 - NOA1 received

10.03.2008 - 01-13-2009 - Untouched (thank god)

11.25.2008 - She arrives in Detroit on her 2 year multi-entry tourist visa.

12.08.2008 - 3rd trip to thailand together for 5 more weeks

01.14.2009 - Return to the states by myself.

01.14.2009 - Petition approved (NOA2 Received)

01.23.2009 - NVC Received Approved Petition / Case # assigned (letter sent)

02.07.2009 - BKK Consulate receives case

02.10.2009 - Packet 3 received with instructions.

02.14.2009 - Affidavit of Support and support documentation sent to Nathaya in BKK.

02.19.2009 - Affidavit of Support received

02.26.2009 - Packet 3 with all documentation (except evidence) sent to BKK Consulate

03.19.2009 - Interview date (Success!!!)

03.23.2009 - Pick up Visa, Passport, and immigration documents at US Embassy in Bagnkok.

04.17.2009 - Trip to BKK to help my fiancee pack and fly back to the USA.

04.21.2009 - Depart with Fiancee to LAX (Los Angeles International).

06.21.2009 - AOS packet sent

07.24.2009 - Biometrics completed

09.07.2009 - AOS Interview in Detroit. (Success!!!)

09.22.2009 - Permanent Resident Card received.
