My hubby is the USC. We got married in Aug.'09, and I have been filling out the necessary paperwork since. We're both students, and neither of us has an income, which is ok in my case since I'm not authorized to work in the US anyway. Here are my questions:

1) Is it a problem that he doesn't work, even if we can find a co-sponsor? I've read of co-sponsors 'supporting' the sponsors income, not being the main source of income.

2)Our co-sponsor is my uncle, who is a LPR, and lives in another state with his wife and child. If we can use him, is his poverty level calculated using his whole family (wife and child)+ my hubby and I, or just him,my hubby and I?

3)Does co-sponsor have to have claimed hubby and I in most recent tax returns?

4)I'm a little confused on what form co-sponsor should fill out, is it I864 or I864A?or I134? and if using a co-sponsor, does petitioner have to fill out I864 as well even if he doesn't have an income?

I have been reading posts since February this year, and although several other questions have been answered in the process,I still can't find exact answers to these questions, so I figured I should ask. Thanks in advance for all the help!

►Nope. My husband doesn't have work yet when we filed our I-130. We have my Mom in law co-sponsored. He used her income.

2)Our co-sponsor is my uncle, who is a LPR, and lives in another state with his wife and child. If we can use him, is his poverty level calculated using his whole family (wife and child)+ my hubby and I, or just him,my hubby and I?

►it would be his whole family (wife and child)+ your hubby and you.

3)Does co-sponsor have to have claimed hubby and I in most recent tax returns?

►I don't have much knowledge on this.

4)I'm a little confused on what form co-sponsor should fill out, is it I864 or I864A?or I134? and if using a co-sponsor, does petitioner have to fill out I864 as well even if he doesn't have an income?

►Your uncle should fill out the I-864. I-864A is for co-sponsors who lives in the same household. (I don't know about I-134, sorry) and yes, your husband has to fill out I-864 as well.

His wife, child and you...not your hubby.

3)Does co-sponsor have to have claimed hubby and I in most recent tax returns?

No

Your hubby fills out I-864 and your uncle fills out the I-864 also.

I also have questions about sponsorship. Can my fiancee use her Uncle as a co-sponsor? Her Uncle lives in California and owns a business.

second question, what are the legal ramifications for the sponsor and co-sponsor if something should happen with the beneficiary during her time in the US? must they be fully responsible for her medical? her run ins with the law? Any property damages she might cause?

I understand sponsors are obligated for 10 years until or until she gets her green card? What if she becomes fully self supportive with a job/career and all that, are the sponsors/co-sponsors still financially responsible for her?

Thanks
