My wife and I were just recently married, her visa was canceled because she was here on vacation staying with her family. While she did this she babysat he cousins and her aunt paid her for it. The second time she came she got a P/T job so she could buy a car for transportation to get around. Both times she did not register for a work visa. When she came back to the states in April, she got pulled aside for questioning, she was honest and told them that she did not do it and got paid for both jobs. Now she is not allowed into the country for 5 years. I need help, a point in the right direction. Something, I do not know of any immigration lawyers within Maryland. If someone can offer some advice on where to go or what to look for I would greatly appreciate it. We just want to be together and at every turn something happens. If someone could let me know we would be in your debt.

Well we are not trying to get her Visa reinstated, we are going for her CR-1.

Im in the DMV area as well. Here is a good immigration lawyer for you to check out. Law offices of Joshua Moses Silver Spring 301 598 9488 or Bmore office 410 563 4300. I tried to use him but he spoke to me for a while on the phone for free and told me I have done everything correct so I did not. Either way I am a Paralegal and its rare an attorney will even speak to you about this stuff that long for free. Try him out. He was super cool wth me. Good Luck to you!

I believe she will have to wait out her ban; unless once her visa is denied (it will be) they tell her she is eligible for a waiver.

The OP does not accept the suggestion for a waver from anyone. If you go back to his posts, you'll read more about his case - it's really complicated. OP needs to talk to an immigration lawyer and get a congressman involved for sure

Well I have spoken with one lawyer he said that it will not have a great effect on her CR-1. But it will take just a little longer and that our interviews may be a little more extensive than other interviews cause we got married after her visa was canceled but we have faith and we believe that God will see us through. We have support and love from our families as well.

Sorry to be blunt, but God has nothing to do with the visa process - God might just have more important things to do

You might want to make sure you get a very, very experienced attorney. Good luck. Any attorney that tells you illegal work does not have an effect on a CR-1 is full of #######.

We got married a week after my student visa was canceled. I was never asked at the interview about this, I've been never asked why we got married. Also, I've been working in USA with expired work authorization, they knew it at the embassy when I was interviewed, they asked me if I worked, did I work with other ppl from my nationality, I answered honest, and was granted a visa anyway. It's up to the embassy, but I think they already have it in mind at the day of the interview if they will grant one or not. It's all about luck, council's mood, who knows what... That's my experience... Good luck to you

I forgot to mention that when we started the process, I had the same issue - I was thinking only about if getting denied because was working "illegal". My husband spoke to a lawyer and the lawyer said that when an immigrant marries a USC the Immigrations somehow "forgive" the foreign person that small violation with the hope when they become US residents and citizens, they'll keep the laws in USA, and because they are married to a USC. Plus, the interview for marriage visa is an interview about you and your spouse and how well you know each other and if you really love each other, it's not an interview for a working visa, right?

No this will be an interview for her CR-1. From our marriage, this has nothing to do with a work visa or tourist visa. We are going for her residency and that is that. Other than the work thing she has never had any violations within the US not even something as little as a parking violation. So I'm hoping that all that will be taken into account. Kind of a all the good you have done out ways the bad by a little bit.
