How many years that it takes for a GC holder to petition her minor child in the Philippines? Thank you!

Currently, it takes about 4-5 years for a GC holder to petition for an unmarried minor child from the Philippines. A case like this would be in the F2a family preference category. Remember that the child has to be unmarried until he/she arrives in the US on an immigration visa. Furthermore, a child may age out by turning 21 and having to wait longer in the F2b category. CSPA will protect the child while USCIS approves the petition but not when the case is at the NVC.

How does CSPA works?

The process will take 4-5 years. You do not need to worry about ageing out or CSPA. Your child will still be under 21 years old in 4-5 years. CSPA works like this in your case. CSPA does not count the time it takes USCIS to approve a petition. There are two stages to getting a visa; 1) Approval by USCIS and 2) Waiting for a visa in the currently family based immigration category to become current.

If you become a USC while your child's case is processing and the child is under age 21, all you need to do is inform USCIS or the NVC (whereeever the case is at the time you become a USC) to upgrade the petition to an Immediate Relative and a visa will automatically become available to the child.

If your child turns 21 years old, CSPA kicks in. CSPA does not count the time it takes to approve the I-130. For example, it takes USCIS 2 years to approve your child's case and it takes a total of 6 years for your child to be eligible for a visa in the F2a category. That means your child will be over 21 years old in 6 years. Normally she would have aged out into the F2b category. However under CSPA, two years would be subtracted from her real age to determine her CSPA age (21-2=19). So she would still benefit from the F2a category.
