getting married while K-1 is being processed?

Is it possible to get married in the US while the k-1 is being processed while not intending to immigrate immediately?

As in : Crossing into the US from Canada, getting married and then returning to Canada? Does the K-1 have to be cancelled and changed to say a K-3?

You would need to cancel the K1, marry and petition for a K3. You can't be married and get a K1 and you can't transfer from a K1 to a K3. Hope that helps.

10/07/2006 WEDDING DAY!

11/14/2006 AOS packet made it to 'the box' after being overnighted.

12/02/2006 Paul had biometrics

12/14/2006 AOS Forwarded to CSC AND AP Application approved.

01/17/2007 First touch of 2007 at CSC

01/20/2007 Touched AGAIN (also the 18th) come on...

February: Oops, RFE for a REGISTERED marriage certificate. Oops! Overnighted it.

02/28/2007 Paul gets email letting us know his GREENCARD is on it's way! It's done...for now!

03/09/2007 Paul's greencard arrives. And breathe...

We began with mailing the I-129 in on February 27, 2006 so the whole process took us approx. one year.

You have to be unmarried in order to get the K-1, and even if you're married to the person who filed the petition for you, it would still make you ineligible for the K-1.

You CAN, however, have a non-legal, purely traditional religious/cultural wedding, provided such a ceremony would not count as a LEGAL marriage in your home country. If you do do this in your home country, I would avoid talking about it to the consular officer, but such things have often been misinterpretted as the couple already being legally married. Proceed with caution, but you CAN have a non-legal ceremony abroad so long as you aren't legally married under foreign law when you apply for the K-1.

10/30/2006: AOS approved without interview, greencard will be sent! :)

11/04/2006: Greencard arrives in the mail! :-D

... No more USCIS for two whole years! ...

You have to still qualify to *use* the K-1 when you get it. If you are not still un-married when you *do* immigrate, the K-1 visa will be of no use to you.

If you got married you'd have to file for a new visa (K3 this time) and start all over again... so it's really not advisable unless there's some life-or-death reason to do it.
