Hi Guys,

I'm trying to start getting all the papers together to file AOS for his GC. Can someone who knows exactly what I need to file plz help me? He is a K-1 and from what I can gather he doesn't need a EAD to work, correct? I've read in posts before to make sure you file for EAD and then I read where if you're a K-1 you don't need to file for it. But, what if where he applies for a job requires it, what will happen then?

I-131

I-864 - times 2 one for me and one for co-sponsor.

I-765 - Other aliens who are authorized to work in the United States without restrictions should also used this form to apply for a document evidencing such authorization. ** Does this mean even tho he doesn't need EAD to work.. he still needs to file for prove if asked?

** Did I miss any forms that I will need?

11/05/09 - Transferred to C.S.C.

11/10/09 - Biometrics - Cancelled waiting for new appt.

12/21/09 - Biometrics - Went well with no problems.

12/31/09 - EAD Card received.

02/16/10 - Transferred to Lee's Sumit, Mo

03/04/10 - Recieved AOS Interview letter.

04/07/10 - A.O.S. Interview - Approved. Very easy interview.

04-26-10 - 2Yr. Green card Received.

there is an Adjustment of Status forum here on VJ that has the guides posted, as well as a lot of helpful tips.

and yes, K1s definitely need EAD to work...

did you two already get married?

As far as I know, K-1s DO need to get EAD to work unless they entered through JFK and got EAD at their point of entry.

even if he did get that its only good for 90 days.

Entering through JFK is no guarantee you'll get a Temp EAD. My husband didn't and he asked for it and they just ignored him. It took 6 months for us to get his EAD, and we filed the AOS packet one month after he arrived (actually a few days less than a month).

The AOS forms are worse than the I-129... I recommend that you read the instructions very well...

If you want I can send you all the forms... Just send me your email address in a PM and I'll send them. You should always look for updated versions of the forms, but it's been 10 months since we did them so they should still be "pretty fresh"..

Rather than list everything you need when you are adjusting status - the Adjustment of Status Guide (K1 & K3 Visa Holders) gives you all the details you could ever get in a thread.

As far as the EAD/Work Authorization - if you want to be able to work, while waiting for the PR/Green Card to be approved, you'll need to apply for the EAD (I-765) - the temp. EAD stamp you may get while going through JFK is truly of little value (long story, but don't bother is the end result). It doesn't cost you any extra (if you file it with or after your AOS) so may as well - takes anywhere from 60-90 days to get. :thumbs:
