My husband and I left our Philadelphia home for the summer and immediately filed for a change of address in connection with our AOS case. We believed that this change of address was successful, but because we never received any official confirmation via mail or e-mail, when we received the e-mail saying that an RFE had been sent out on July 21, 2009, we called USCIS to make sure that the letter was going to our new address. The immigration officer we were transferred to on July 21st initially told us that she did not have any record yet that an RFE had been sent out, but that the address for the case was still our old address. When I told her that we had processed a change of address online in May, she checked this and confirmed it, and told us that the letter should probably be going to the proper address, although she could not tell for sure. When we had not received it after one week we called again (July 28, 2009). This time the immigration officer we spoke with told us that the letter went to the wrong address and that she would process the change of address and have the RFE sent out again. This took 2 ½ weeks, and we ended up getting our RFE on August 17th, only three days before it was due back in California!

The RFE asked for letters of good conduct from the local police stations of every place in the US where my husband has lived because his fingerprints didn’t take, which is not feasible in such a short time, and even worse, they seem to have confused our case with someone else’s, claiming that some physician we have never heard of from Texas, where we have never been, examined my husband and said that he did not meet the requirements on a date which was 2 ½ months after our application was filed!!! I called USCIS and they said that neither the address mix-up nor the medical mix-up could get us an extension on the RFE, so we just sent in what we could gather in 2 days – including a cover letter which basically points out the obvious mistake re the medical (although we couldn’t get a new report in the time required) and a statewide online police records check saying that there was no criminal record for him in one place we’ve lived and a note from the local police in the other saying the same. I am really concerned that because this is arguably not sufficient we will be rejected and have to start from scratch. Does anyone have any suggestion of ways to appeal this or prevent it from happening in the first place given the mistakes on their side? I called USCIS twice and was transferred to immigration officers but they were no help at all just rattling off the same old message that we had to submit what we could by the date given…

i m sorry to hear that you guys have an RFE , but dont worry too much , everything is going to happen in time inshallah, i think you should contact your senator or congressman and explain the situation. i m sure there is someone out there who has been through this and have the appropriate answer.
