hi everyone, im very confused about question 16 on the I-765? I am filing for my wife(k-1) and step-daughter (k-2). well 1, i dont think i need to file one for my step daughter because she is only 12 years old. but if i do what is the category? what category do i put for my wife??? ive read around and seen c(9).....is that her category? if so how do i write it in? there are 3 blank spots in parenthethis ().......(all in the first or c in the 1st and 9 in the second....etc).

thanks alot, im really behind with all the AOS, we just got married on saturday and her K-1 expires on the august 22. im going to try to have everything ready to send out by next week, alittle late but better late than never.....

I'm K-1 applucant and i put 9 ©. let's see what everybody says :)

Eligibility category is "C" "9" if filing with the AOS/I-485 (don't worry about the third parenthesis) - you may want to consider the EAD for the daughter - obviously she can not work, but very often the EAD will come in handy for school registration (should the PR/Green Card take a bit longer). Something to think about.

will the total cost increase or stay the same if i send in an I-765 for my step daughter? i know the cost is $1010 (k1) and $600 (k2) but i dont know if the $600 for the K2 includes the I-765......regardless of that, isnt it a national law that all minors 16 and under MUST be inroled in school legal or illegal? i thought i heard that.....

There would not be an additional fee.

Not sure what you mean in regards to the school thing..
