Hello there,

As posted topic title is my question will be about AOS..:-) After we file for AOS and will be awaiting for our first NOA how can i legally proof that my status is not " Out of Status " but " AOS applicant ". Because i'm going to apply for drivers license i need to show them the proof about my legal status in the U.S for this moment and i need some documentary proof about my legal status in the U.S.

Please, does anyone know is there any letters or documents that will show i'm an AOS applicant and my status is legal?

you need to have a greencard I'm not sure about EAD though to get a driver's license. The DMV won't accept NOA1 because it only shows that your application is on process.

Yes, you will need to wait until you have documentary proof from USCIS that you are legally in the country. I doubt that the Department of Motor Vehicles will accept the NOA receipt for the AOS but as it varies from state to state you may be in luck. You should be able to get a DL with the EAD, however, and definitely with the green card. Check online and see what your state requires to issue a Driver's License. I know in Georgia they don't accept the NOA notice.

You cannot prove it until you have the NOA1 from filing AOS, but "out of Status" is not illegal. I see your local office is St Albans, so I presume you are in Vermont? You will need the NOA1 and a copy of your marriage certificate to get a drivers license or permit (or state ID). Vermont requires you show you are legally enitled to remain for minimum 180 days and they accept the marriage certificate and NOA1 from AOS as sufficient. Just have to wait. We got ours within two weeks of filing the AOS for both Alla and our oldest son, to follow. We filed his AOS July 17 and recieved the NOA1 August 1. Our son will have his drivers license test next Thursday. (earliest date I could get...grrrr)

All you need to "prove" your legal status is your passport with visa, I-94 and copy of your marriage certificate.

Just as an aside, when we went for Alla's drivers permit they told me to bring the marriage certificate and "I-797C" from the AOS. In my haste that morning, and since I had not organized and put away all our files yet I grabbed the I-797C approval for the petition...our "NOA2" I didn't even realize it until after they had issued her permit. They are ALL I-797Cs and I guess that was all the clerk looked at (and all I looked at). I never bothered to correct them, we DID have the correct paper and she WAS legally qulaified, I just grabbed the wrong piece of paper.

you are lucky then ;-) :thumbs: Ok, i can provide my i-94 but right now i'm feeling i'm not ready for the test because i have to study all that rules in the book. and i would like to have a little bit extra time,too like one more week. but my i-94 expires soon before i get ready :( Is it still okay if i show them copy of marriage certificate?
