Hi all:

I received EAD and AP last week and today received the interview notification which is Sep 2nd. The thing is my husband (the petitioner) is till in my home country because we prepare to hold a merriage ceremony in hometown in December. He also has a part-time job there now and doesn't want to quit for now. Is there anyway I could delay the interview till maybe January of next year? I know there is no way I can schedule the date, but if next time they send me another date such as October, what should I do? Anyone ever delays the date for multiple times? or how many months in general they delay it?

It is actually a bad idea to try to re-schedule an AOS interview. Others on VJ have tried to do so and been unsuccessful. USCIS generally doesn't reschedule an AOS interview except for extreme circumstances - matters of life and death. Where USCIS has been the one to cancel an interview and said they would reschedule it, individuals have later received a notice that their AOS was denied because they failed to show up for the interview - even when they were told it was cancelled. It took these couples a lot of time and money to get the files re-opened.

As harsh as it may sound, your green card status is actually a higher priority than your marriage ceremony in your home country right now. At the very least your husband should take a few days off of work and return to the US to be here for the interview. I know it will be a hassle and will take time and money - but it will be a lot less hassle, time and money than you would face with trying to re-open an application denied for a missed interview.

I strongly suspect that even if you go for an infopass appointment, they will tell you the same thing.

Thank you so much! I just emailed my husband and I also think he should come back for this. Even if I reschedule the interview, what if they send the letter again and say come in November and we still could not come? Better attend at the right time. Thank you so much!
