Hello,

I have a question about my drivers license (state of Georgia). I got my drivers license in June and is set to expire on the same day on I-94 expires which is 08/27/2009. Anybody know how I go about getting it renewed? AOS was filed and is in pending for processing after recently being transferred to CSC. Biometrics appointment is 08/21/2009.

How do I go about renewing this thing? The people at the Department of Driver Services seemed pretty keen on August 27th being the expiration date when I got it in June.

Any thoughts, experiences or feedback appreciated.

Thank you,

Presumably 08/27 is the day your I-94 expires - can't say for sure about the state of Georgia but it would seem they will need proof of legal status in order for you to get another/renew your existing DL. That may be the EAD or it may be the PR/Green Card. Check local DMV requirements.

To renew your DL in Georgia you will need a 'new' immigration document proving that you are here legally and giving a specified date. Did you apply for your EAD when you applied for your AOS? If so, that will probably arrive in earlier than the green card and you can definitely use the EAD to renew your DL. It will be renewed for the same length of time as is on the EAD - which is one year from date of issue - or if you use your green card, for 2 years. Georgia will renew DL for non-citizens for either the length of validity left on your immigration document or 3 years - whichever is least.

Do you have an EAD yet? Once the I-94 has expired, you will need either an EAD or a GC to renew, I'm afraid. A receipt showing you've applied for a document is not acceptable to the DDS.

Frankly, I'm surprised they gave you one at all based on a 90-day I-94 - they (Cumming DDS office) told me in no uncertain terms that I would require either an I-94 with 6 months+ validity, an EAD or a GC in order to be issued an LP/DL.

Copy & pasted from the DDS website, these are the documents acceptable for proving legal presence:

1. Valid (not expired) foreign passport with I-94 or I-551

2. Temporary resident alien card (I-688)

3. Permanent resident alien card (I-551)

4. Employment Authorization Card (I-766) or (I-688A)

5. Employment Authorization Document (I-688B)

6. Refugee Travel Document (I-571)

7. Reentry Permit (I-327)

(Actually, I see there's no mention of the 6 month requirement for I-94s on that list any more, perhaps that restriction has been lifted now or the customer service agent was wrong to tell me that (likely).)

Thanks for all the responses. Having you guys with experience in Georgia solidifies it for me so I appreciate your responses.

I applied for EAD at same time as AOS filing so hopefully that will arrive sooner rather than later. Green Card is probably still a long way's off as the notice date on first NOA was July 20th.

I went to the DDS in Marietta and had no problem at all getting them to issue the license with the documentation I had (my passport with I-94) and my SSN card. I just hope when I go to renew the card that they don't make me take the tests over again as I did the written and road test to get the temporary permit already.

I wonder if there's a quick way to extend I-94 until EAD arrives.

You won't have to take the computer test again so long as you renew the learner's permit within 2 years of it's original expiry date (so no way it should be an issue).
