Hi Friends,

I got a married to a Green card Holder in 2008,May.Marriage took place in India and she went back to complete her studies. She got citizenship interview date,scheduled on 17th September 2009. Pls help me with the following querries:

1. Shall we file for I130-DCF from India or from US.?

We heard that filing from US will now take only 6-8 months (She filed N400 on July 2nd,2009 and the citizenship interview is scheduled on 17th September 2009). So if she files for me from US in October 2009(once she become a citizen) , hopefully by April/May 2010 we will be together.On the other hand, she is planning to come down India on December 2009 and to stay with me for 3 months(if the current rule of 90 days is valid in India) and then go for DCF from NewDelhi in March 2010.In this way hopefully by May/June 2010 we will be together.But we are totally confused where to file ....

2. I am in Cochin currently and if we want to show the residence evidence, which document should I present???I do not own a home and is staying on rent here...

3. The new G-325A form has only 1 page to be filled out(4 pages earlier). I worked and stayed across 3 states in the past 5 years. If I fill the same , will I be asked to get PCC from all the 3 states???

4.Also, if we intend to file from US , can we do it ourselves???The attorney in US is asking to pay around 3K as their fees (incl. application submission)

We understand the pain of thousands who are in the same situation and we refer this forum daily.Pls help us to get me a clear picture ....

NVC Journey

27-01-2010 NVC received the case

05-02-2010 Bill status shown as PAID

08-02-2010 Sent DS230 and AoS packages

10-02-2010 NVC received the documents

19-02-2010 AVR updated saying "missing information"

23-02-2010 RFE-email received from NVC for incomplete biographic information [Q30]

24-02-2010 Hard copy send back to NVC with DS230-part1 filled and signed along with the bar code letter received

02-03-2010 AVR updated-"NVC received the checklist response on March 2nd"

08-03-2010 Login Failed !!! AVR updated-"Your case was completed on March 8th"

11-03-2010 Interview scheduled on 13-Apr-2010@Chennai,India-email received from NVC-

43 days@NVC and 156 days from I130 filed for case complete...!!!!!!

16-03-2010 Packet reached Chennai Embassy (used DHL tracking method)

22-03-2010 Chennai website updated with my case# in the April IV appointments!!

30-03-2010 Medical exam scheduled@Appolo,Chennai

1- If you are able to file DCF you can if not mail to the US...choice is totally yours. The estimated time is 6-8 months, however it took our petition a year to approve and its been two years, now we are at the last stage of AP which God only knows how long it will be...so plan accordingly.

2- You can provide your rental agreement and possible sign an affidavit that she is staying with you at that address.

3- If they have different police jurisdictions then yes.

4- Yes you can file yourself. Just carefully read and complete all documents, if you follow with other VJ members you should be fine

THe person sponsoring the immigrant can only file DCF if they have resided in that country legally for 6 months continuously, so filing after a 3 month stay is not an option. However, DCF does tend to be much faster.

You are required to get a police certificate from any place that you you resided for 6 months or longer, no exceptions.

The G325 the pages 2-4 of the G325 are merely copies of the first page. Whether filing here or there, you can do it yourself if you are confident in your ability to comprehend the papers and follow the instructions in English. It really is a very straight forwared process, just very paper intensive.

Unless there are extenuating circumstances, I would say yes, do it yourself and save the 2,000 USD. The fees for filing total about 1000 USD.
