Hey guys,

Thanks for answering. I received a Request for Further Evidence, through my email and the hard copy is not yet in hand. I was wondering if I can call to the USCIS to find out what are the papers they need so I can accelerate the process. Also which is the formal way to send the papers, do they need a "cover letter" as with the K-1 visa pettition we are filling for? How much time do we have to respond to this RFE, and how long, normally do they take to answer.

Please!!!! help!!! we do not need more time waiting.. we've had enough and gone through enough!!!

  1. Calling won't get you any farther than where you are now - You'll have to wait for the actual RFE notice in the mail.
  2. When responding to the RFE, you'll have to submit the actual RFE notice (the original) along with what ever documents/evidence they are requesting. Making a cover letter isn't a bad idea.
  3. I believe you'll get 90 days to respond (I suppose more if you need it) - plenty of time for most things. Most RFEs are relatively simple to respond to and don't cause a huge delay - usually takes a week or two for your case to resume once they receive your response (good news there, if you respond with what they need, the next step is to approve your petition).

Actually, this is a blessing in disguise for you.

When you respond to the RFE (whatever it is), also include every scrap of "evidence of relationship" material that you can lay your hands on -- complete phone records, dozens of e-mails, printouts of your respective e-mail logs of messages to and from each other, more (MANY more) photos of yourselves together than you may have sent, and anything else that you can think of to include that is evidence of relationship.

Also, collect one-page, signed, hard-copy letters from relatives, friends, employers, colleagues, ministers, and others in which they state that they know of your relationship and that they consider it to be genuine. Make sure that the writer knows the correct spelling of your name(s) and when your relationship began; other than that, let them use their own words. Each letter should be signed and should contain the complete contact coordinates of the writer. The letters need not be notarized. If hard copies cannot be procured, e-mails will do. Fortunately, this RFE enables you to collect such letters while you await the RFE.

Include these letters and everything else in your return mailing to USCIS when you respond to the RFE.

The reason for this is that, although USCIS does not care about the extra enclosures, the Guayaquil consulate (where you would eventually be interviewing) is a hellhole that has caused untold misery for dozens of interviewees. The consulate routinely throws interviewees out of interviews after a couple of minutes and refuses to accept evidence that is brought to the interview, with the claim of "insufficient evidence of relationship was presented." After that happens, almost no amount of further evidence will be enough. Read the Latin American subforum thread "US Consulate in Guayaquil, Ecuador" for just some of the nightmare stories. Including such evidence in the I-129F filing to USCIS (or along with an RFE) takes away the consulate's routine excuse that insufficient evidence exists, because the consulate knows that USCIS has seen it.

Finally, if the U.S. petitioner is not present at the foreign fiance(e)'s first interview, the visa WILL be refused. You can bet your lives on it.

Your following the above advice will enhance your chances of being issued the visa. If you ignore any aspect of these recommendations, you can't say that you weren't intensely warned. You can be very, very thankful that you received an RFE and that you posted to VJ about it.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hey Kata, I'm waiting my letter to see why the denial was...

TBoneTX... You look like you know about this can you tell me if theres good opportunity to fix a denial, we still don't know why but I know is not like an RFE... do you think I can still get it or I have to give up on getting the visa K1?

Thank heaven that you won't be blindsided and hosed like the rest of us were, K., si man. We're fine; she's in Ecuador now, and I'm flying down there later today. Thankfully, her AOS process was timely and utterly uneventful -- after the consulate, I had no gaskets left to blow!
