just got married to a US citizen,change of status from tourist to immigrant

hi there, i arrived here at US last feb,2009 on a tourist status, and they gave me 6 months (til august) to stay in the US, but last july 7,2009 i got married to a US citizen bf and we filed the papers,the form I-130, concurrently with Form I-485 on july 24,2009. Two weeks after, we received a mail from uscis confirming that they received my application of form I-130. BUt my problem is, my stay in the US will expire this august 25, do i really need to go back to the philippines? or is it possible that with the remaining days of my stay,i will received their response,for me to know the decision which means should i wait more days before my stay expiration date for the result or response of the immigration?is it possible just to continue my stay in the US even my stay expired since they already have my application without affecting the process of my papers or do i really need to wait for the right response from the uscis if i need to go back to my country or not. please help me..thanks!

Actually you CAN'T leave the country untill you get an answer from your petition. Your status right now is not turings but pending since you applied for AOS, so it really doesn't matter when your tourist visa expires. Don't leave the country.

the above advice is correct. your AOS application allows you to stay beyond your visa date and until a decision is made on your case. and if you do leave after a decision is made and without an AP (advance parole) that would constitute abandonment of application and you'd have to apply for the proper immigration visa to come back.

once you get your "application received" notice your safe to stay here beyond your visa expiration

All the posts above are correct. Your application is now pending. When you have applied for I-485, you were not out of status anyway.

I wouldn't worry about that but I would worry about questions to be asked by IO during the interview. Like you got married to your husband after 5 months upon arrival to US. That is kind of a red flag. Believe me you will have to answer lots of questions. I am not saying it is not possible but will be difficult one.

thanks for the time in reading my post and for the replies...so now there will be no worries regarding my stay here..yeah ill just be prepare and pray for the IO questions,etc..thanks guys!!GOdbless!^_^
